In connection with the low-intensity cycle blast occurred at Anna Nagar in Madurai and the ongoing State Conference of BJP at Madurai the Special Intelligence Cell (SIC) headed by Mr. Mari Rajan, Assistant Commissioner of Police along with Madurai city and rural cops harassed Muslim Community in the name of investigation. A Public Interest Litigation (PIL) was filed by the advocate A. Syed Abdul Kather, legal cell of Popular Front of India to stop the harassment of the police and the violation of fundamental rights guaranteed by the Constitution of India as well as the guidelines of the Supreme Court.
The writ petition came up for hearing here on today before Hon’ble Judges M. Sathyanarayanan and Hariparanthaman. NCHRO State Secretary, advocate S.M.A. Jinna, counsel for the petitioner argued the case that the police and SIC violated the guidelines of D.K. Basu case and in the name of enquiry only Muslim community is being targeted and they treated the Muslims as the criminal tribes. Mr. Chellapandiyan, Additional Advocate General (AAG) for the Respondents argued that the police have done only general surveillance in connection with the arrival of BJP National leaders and not targeted Muslims. The hon’ble judges asked the AAG, why the SIC cops went to the petitioner’s house for enquiry, who is not having any criminal antecedent. Mr. Jinna argued that the Hon’ble court to direct the Respondents to file their version as affidavit.
The hon’ble judges directed the AAG to file the affidavit in the afternoon sitting. The AAG pleaded that today BJP state conference is going on. So, the police officers are engaged with the security arrangement. The hon’ble judges refused to accept that plea and told that not to say that reasons in the court. The respondents should file it anyhow.
Followed by the direction of the court, the AAG filed the counter affidavit of the sixth respondent Mr. Marirajan ACP, SIC. Mr. Jinna argued that the averments in the counter affidavit are not true. Then the hearing was posted on 17th of May to file the rejoinder of the petitioner and further argument.
